IN INDIA CRIMINAL LAWS ARE STILL SOFTER THAN GST LAWS

The basic principle in Criminal law is that the guilt of the respondent/accused must be proved beyond reasonable doubt and if there is the slightest doubt about the commission of an offence then the benefit has to accrue to him

Genuine ITC of Purchaser is denied for the mistake of Seller & that's GST Laws of India
Can we safely presume that GST Laws have harsher provisions than Criminal Laws?
Or in Criminal Laws, one might get some relief but the concept of mens-rea is established in GST Laws???

G20 leaders approve global tax reform deal

 

G20 leaders have formally endorsed the global agreement for a minimum 15 percent corporate tax, US Treasury Secretary Janet Yellen said Saturday, hailing it as a "historic" step.

"Today, every G20 head of state endorsed an historic agreement on new international tax rules, including a global minimum tax that will end the damaging race to the bottom on corporate taxation," she said.

Some 136 countries representing more than 90 percent of global GDP have signed a OECD-OECD-brokered deal to more fairly tax multinational companies and enact a minimum tax on global corporations of 15 percent.

WHY? I DO NOT LIKE (SO CALLED MAHATAMA) GANDHI AND (SO CALLED PANDIT) JAWAHAR LAL NEHRU.



 "He is a mad man", said *Gandhi*.


"His act was a senseless deed", said *Nehru*.

"We condemn his act of terror and apologize and hope we are not punished for it" -resolution passed by *Congress*.

He was *Shaheed Udham Singh* and the senseless deed he did was that he killed *Michael O’Dwyer*.



Michael was the *monster* who massacred 1,526 innocent, unarmed, peaceful Indians gathered in *Jalian wala Bagh in 1919*

Udham Singh was a 19 years old volunteer, who was serving water to the 20,000 people gathered in the garden on the festival of Baisakhi.

They were brutally massacred by Gen O’Dwyer and Udham Singh was live witness to it.

He wanted to avenge the brutality and get some sense of justice to these martyrs. 
British Govt didn’t take any action (as anyone may expect.

*Congress couldn't get British to act on O’Dwyer*

So O’Dwyer happily retired to England and was leading a peaceful rich life.

Meanwhile, *Udham Singh joined Gadhar Party and fought for freedom*
He was jailed for 5 years and there he was inspired by death and martyrdom of *Bhagat Singh* who wanted to take action against O’Dwyer.

After release, he escaped from India through Kashmir. He went to Germany and then to London.

He joined as an engineer and pursued O’Dwyer for 6 years. He procured a gun, learnt shooting and then found that on 13, March, 1940 O’Dwyer was speaking in Caxton Hall, London.

Udham Singh hid the gun in a book by carving a place for the gun, sat in front row and shot two bullets into heart and lung of O’Dwyer.

O’Dwyer died instantly.

Udham Singh didn’t escape. He bravely courted arrest.
 
He told these words to the judge:
*"I did it because I had a grudge against him. He deserved it. He was the real culprit. He wanted to crush the spirit of my people, so I have crushed him. For full 21 years, I have been trying to seek vengeance. I am happy that I have done the job. I am not scared of death. I am dying for my country. I have seen my people starving in India under the British rule. I have protested against this, it was my duty. What greater honour could be bestowed on me than death for the sake of my motherland?”*

He was sentenced to death in the court. 
He fasted for 42 days in the jail and was brutally tortured and hanged on July 31, 1940

Meanwhile in India *Congress condemned his act. Gandhi and Nehru abused him for making British angry and they forced Congress to pass a resolution against killing of O’Dwyer.*

They were very busy those days helping British recruit Indian soldiers for World War-II and they didn’t want Punjab to get upset wirh British.

This is our great freedom fighting party which condemned killing of monster O’Dwyer, who massacred 1,526 people in Punjab.

*Udham Singh was buried in London and like other freedom fighters, he is forgotten in India*

*No textbooks talk about him.*

Few people know about him.

*I am happy that they are making a movie on this patriot and coincidently it will be released on Gandhiji's birthday on Oct 2. His story is really great and inspiring one.* 

Mayawati named a District in Uttarakhand after him in 1995, perhaps the only good deed she has done in her life and in 1974 his remains were exhumed and brought to Bharat and he was cremated here.
 
His ashes are in an urn in *Jalian Wala Bagh*.

 दिल्ली विश्व विद्यालय मे नंबरों के आधार पर दाखिला मिलता है, मेरी बेटी पृथा (रिंकी) ने 2003 मे जब फार्म भरा तो उसके आर्ट्स मे 88% नम्बर थे तो दिल्ली विश्व विद्यालय ने रायपुर बोर्ड से इंक़वायरी की थी की आर्ट्स मे इतने नम्बर कैसे मिले इस छात्रा को , DU के संतुष्ट होने के बाद ही मेरी बेटी रिंकी को लेडी मिरांडा हाउस कॉलेज मे एडमिशन मिला था, तब उसने BA आनर्स के साथ किया और उसके फाइनल मे भी लगभग 88% नम्बर ही आये थे। 

पर आजकल ये क्या नया नाटक चालू हो गया है?? कट ऑफ100% याने 99•99 % वाले को भी एडमिशन नहीं मिलेगा। 
पूरे विश्व मे ये पहला उदाहरण है। दुनिया चकित है, केरल के महाज्ञानी छात्रों के नम्बर देख कर। 

आज TV पर बताया गया कि केरल बोर्ड से 100% नम्बर लेकर आये चार हजार से ज्यादा छात्र छात्राओं ने दिल्ली वि वि मे फार्म भरा जिसमे एक ही कॉलेज मे, इतिहास मे 38, भूगोल मे 34, गणित मे 45, बायोलॉजी मे 51, अंग्रेजी मे 50 बच्चों को एडमिशन मिला। जितने भी केरल के छात्रों ने फार्म भरा सब के सब दाखिला पा गए। ये एक कॉलेज का परिणाम था बाकी चार हजार को भी अन्य कॉलेज मे दाखिला मिलना तय है । 

 गौर तलब है कि गणित मे तो समझ मे आता है की 100% नंबर मिल सकते हैं , पर इतिहास, भूगोल, बायोलॉजी, और भाषा मे 100% नम्बर तो नामुमकिन ही है। 

इस घोटाले को पकड़ा दिल्ली वि वि के प्रोफेसर राकेश पांडेय ने प्रो.पांडेय 2016 से ही इस बात पर गौर कर रहे थे , पर उनकी बात वि वि प्रशासन और मुख्य मंत्री तक ने नकार दी, तब उन्होंने ये मुद्दा TV पर उठाया तो हड़कंप मच गया, अब जाँच हो रही है। 

ये पूरा खेल केरल की वाम पंथी सरकार का है जो नेहरू के मदरसे JNU की तरह दिल्ली वि वि को भी अपना अपराधी अड्डा बनाना चाह रही है। 

वि वि के शिक्षकों का कहना है की केरल का ढिंढोरा पीटने वालों सुनो इन छात्रों की ना हिंदी अच्छी है ना ही अंग्रेजी भाषा, उनका उच्चारण ही गलत होता है जो समझ ने नही आता, और जब केरल की शिक्षा का स्तर बहुत ऊँचा बताया जाता है तो 2000 km दूर केरल से कमतर स्तर वाले दिल्ली क्यों आ रहे हैं ये छात्र ?? 

जब ये बात प्रोफेसर पांडेय ने उठाई तो उनको धमकी मिलना शुरू गयी, शशि थरूर जैसा आदमी उनकी आलोचना करने लगा, असल मे ये सारे वाम पंथी और कांग्रेस टुकड़े टुकड़े गैंग JNU की तरह दिल्ली वि वि को बना देना चाहते हैं, अब देखना ये है की ये हरकत भारत के और कौन कौन से वि वि मे की जा रही है। 

सबसे खास बात ये है कि केरल मे आन लाईन परीक्षा भी नहीं हुई है। छात्र को व्यक्तिगत रूप से परीक्षा मे बैठना पड़ा था, जबकि आन लाइन परीक्षा देने वाले छात्रों जो किताबें देख कर और कंप्युटर रख कर परीक्षा दिये हैं उनको भी दो चार को ही 100% नम्बर मिले हैं। 

इसके पूर्व UPSC मे उर्दू को माध्यम बना कर षड्यंत्र रचा गया था जिसमे जांचने वाले भी मुस्लिम ही होते हैं दूसरों को उर्दू आती ही नहीं तो जाँच भी उर्दू जानने वाले ही करते रहे। उसमे भी 100% नंबर देकर मुस्लिमों को IAS, IPS, आदि जगह पर 2009 से घुसेड़ रहे थे, 
 शाह फ़ैसल आदि ऐसे ही टॉपर बने थे।

केरल मे कानून की डिग्री मे शरिया कानून एक सब्जेक्ट है। अब ऐसे वकील कल को हाई कोर्ट, सुप्रीम कोर्ट मे पहुंचेंगे तो क्या हाल करेंगे भारतीय कानून का ये विचारणीय प्रश्न है। 
           जागो अफ़ीमची हिंदुओं जागो।

Loot of PSU airlines :-Few reasons as to why Govt.Airlines like AIRINDIA collapsed.? Thanks to Mr.Modi our P.M. for selling off AirIndia and congratulations to Mr.Ratan Tata for buying AirIndia back.

 



1. My aunt was an air hostess with Indian Airlines. In 1992 she bought a flat in Feroz Shah Road, Delhi, for around Rs 3 crore. How did she save that much money? She said, "In the past 20 years with IA, I never had to pay for food, transport or rent." 

2. Air hostesses would take home all sorts of stuff - cookies, juice, cutlery, food, chocolates. If you flew in the 1990s, you would remember they rarely brought an extra coffee or candy. They just carted home everything at the end of the flight. Passengers be damned. 

3. She said, in Air India, every employee (even a Class IV sweeper) was entitled to one free ticket for entire family to an international destination. Often they were bumped up to First Class at the airport. Indian Airlines employees enjoyed similar perks. 

4. Air hostesses and stewards of Indian Airlines vied to get on the Gulf and South East Asian routes as this allowed them to bring electronics which they sold in Delhi's Palika Bazar and Gafar Market. Pilots also became couriers. 

5. I bought my first Sony Handycam in 2005 from Gafar Market. Through a photographer friend, I approached the shopkeeper who asked me which model number I wanted. This model was given to an IA pilot who brought it a few days later. Total cost Rs 17,000. Original Made in Japan. 

6. Imagine this loot happening for the past 70 years. Every few years, the govt bailed out Air India and Indian Airlines with tens of thousands of crore rupees. They were kept alive on a drip feed because it allowed the political leadership and bureaucracy to siphon resources. 

7. Air India was the first airline in Asia to acquire a jetliner - the Boeing 707. It was a prestigious and profitable airline under the Tatas. The Maharajah was synonymous with luxury and upmarket. The govt ran the airline into the ground. 

8. In 2014 or so I saw an older air hostess reprimanding her junior in front of passengers. She could have offered stiff competition to an ogre. Even a 2 star hotel would not have hired her as a room cleaner. She didn't look like she had passed an exam. Definitely sifarshi. 

9. India's average living standards and per capita income place it 10 or 20 times below the West. Despite this, we maintained two white elephant airlines that sucked in incalculable cash. There are still many sectors remaining where such loot is going on. 

10. It took Narendra Modi 7 years to privatise Air India. This is because the political leadership and bureaucrats benefitted from free flights and job placements for their sons and daughters in the airline. Plus, loot of fuel. Catering contracts to companies floated by INC. 

11. Because PSU loot has support from nearly all political parties except BJP, it is nothing less than a miracle that this has happened. I'm surprised the Supreme Court hasn't jumped into the ring and cancelled the sale.

RBI bans Haribhakti & Co from undertaking audit assignments for two years By Joel Rebello ET BureauLast Updated: Oct 12, 2021, 11:42 AM IST

​​"This action has been taken on account of the failure on the part of the audit firm to comply with a specific direction issued by RBI with respect to its statutory audit of a systemically important non-banking financial company," RBI said without naming the NBFC.

The Reserve Bank of India (RBI) has barred chartered accountant firm Haribhakti & Co. LLP, from undertaking any type of audit assignments for any entities regulated by it for a period of two years with effect from April 1, 2022.

"This action has been taken on account of the failure on the part of the audit firm to comply with a specific direction issued by RBI with respect to its statutory audit of a systemically important non-banking financial company," RBI said without naming the NBFC.

Cultural differences are a part of life in a global world; no one has the same worldview as you and what might be common sense in one place may be completely unexpected in another. So, what are some of the cultural do's and don'ts when it comes to visiting Japan?

We asked Eric, a MATCHA writer from Taiwan who has been staying in Japan for some time now, "what should he have known before going to Japan". We will tell you the four things we learned from him.

If you are from abroad, please consider this article as a series of tips for making your stay in Japan go more smoothly. And if you are Japanese, this article should give you some useful information on how to treat visitors from other countries.

1. Walk on the Right Hand Side of the Sidewalk

In general, "walk on the right hand side of the sidewalk" is one of the rules in Japan. If you live in a country which has the opposite rule, you might get confused or caught up in a crowd.

Walking on the left except in areas with signs indicating which side to walk down could get you pushed off course, or block others from reaching their own destinations. It's just an overall unpleasant experience, so it's a good idea to keep this rule in mind if you want to avoid unnecessary stress when walking about in Japan.

This is a rule not only on sidewalks but also on paved roads. So if you ride a bike, especially in Tokyo, you need to be careful. Bikes and cars should keep to the left, and in most places bikes are not permitted on the sidewalk, no matter what you may see others doing. Please do not ride your bicycle on the right side of the road.

Furthermore, manners regarding escalators and stairs might be different from your own country. In general, if you are facing the stairs, the left is the up-side, right is the down-side and, on an escalator, you should not stand in the center of the step. Just watch what those around you are doing and you should be fine.

2. Carry Your Backpack in Front of You on Packed Trains

Visitors are always surprised by just how crowded trains during the rush hour are in Japan.

You might notice that people around you are staring at you once you manage to crush yourself into a crowded train. It is most likely because of your backpack.

If you wear your backpack on your back, it will occupy more space than you need in a train where there is barely enough space for all the people trying to ride it.

You might get a cold stare or on particularly crowded trains, get shoved a bit more aggressively than needed. But you can solve this easily. You just need to remove your backpack from your back and wear it on the front or hold it in your arms when you get on the train. If for some reason you cannot hold your backpack in front, if it is small enough you can just wear it on one shoulder. Ideally you should try to put it up on the rack over the seats if it is that bulky. The people around you will really appreciate it.

3. Wait To Be Guided by the Staff in Restaurants

In the majority of restaurants in Japan, you do not go straight to an empty table and seat yourself, even if you don't see anyone else waiting in the restaurant.

It is better to ask a staff member first to guide you to a table when you enter a Japanese restaurant.

There are various reasons for this, such as the fact that they haven't yet cleaned the table up, they might be closing between lunch and dinner, or are not ready yet to serve tea or water.

Guiding customers to a table after everything is ready is how the Japanese restaurant staff usually do things. They need to make sure everything is alright before customers sit down in order to give each customer the best experience possible.

4. The Bill at a Japanese Bar Could Be More Expensive Than You Think

Are you interested in izakaya, Japan's version of a pub?

"I would love to go to an izakaya while in Japan" is something that many visitors to Japan think. But do you know about otōshi and sekiryō which will be added on to your bill? You might be so confused when you get the bill, that you will think you are being ripped off.

Otōshi is a small portion of an appetizer you receive before you get the drinks or dishes you ordered in an izakaya. It is automatically given and charged for when you order alcoholic drinks. Usually, you cannot avoid paying for otōshi even if you don't eat it. If you are confident in your Japanese speaking abilities, you could try to ask the staff if it is possible to not have otōshi brought to your table.

Sekiryō is a table charge, sometimes called chājiryō (charge fee) or nyūjōryō (entrance fee). You might be charged this at higher quality restaurants and bars, or after a certain time at night; it depends on the establishment. You should ask before being seated or ordering if you will be charged for your table or not.

Things which are common for the Japanese could be uncommon for visitors from other countries. There are a lot of social rules to follow if you want to get around smoothly in Japan, many of which aren't immediately obvious to newcomers to Japan. If you keep these points in mind and try to be as respectful as you can of cultural differences, you shouldn't have anything to worry about in Japan. If everyone respects each other's cultures we can all increase our levels of intercultural understanding.
