Sebi mulls bringing MFs under insider trading rules At present, mutual fund units have been kept out of the definition of ‘securities’ under the Prohibition of Insider Trading (PIT) Regulations. ET NOW

New Delhi: The Securities and Exchange Board of India (SEBI) has reportedly put up a plan to bring mutual fund deals under strict insider trading rules in an attempt to prevent key executives of the mutual fund industry from misusing sensitive information.
At present, mutual fund units have been kept out of the definition of ‘securities’ under the Prohibition of Insider Trading (PIT) Regulations, and buying and selling of mutual fund units has been excluded from the definition of ‘trading’.
The market regulator has sought feedback from the public till July 29 on whether there is a need to amend the insider trading prohibition regulation to bring the mutual fund industry also under its purview. Further, this proposal has been made in view of the allegations of front-running at a large fund house.
In a discussion paper issued, Sebi has said that it has found that the Registrar of Mutual Funds and Transfer Agent (RTA) had encashed all their units from a scheme as they had some sensitive information related to the same. It has also been observed that some top players of the MF industry have redeemed their holdings on selectively possessing sensitive information and did not pass on the same to the unit holders of the scheme.
“MF units of mutual funds are specifically excluded from the purview of PIT Regulations. A need has, therefore, been felt to harmonise the provisions in PIT Regulations to initiate serious enforcement actions against those who misuse the sensitive non-public information pertaining to scheme of Mutual fund, directly or indirectly, which they have access, by virtue of their fiduciary capacity,” Sebi said in a discussion paper.
Sebi has considered applying ideas like connected persons, designated persons, closure period, and pre-clearance for MF transactions. Along with this, a code of conduct will also be made for the persons concerned. This will be applicable to all persons who handle unpublished price sensitive information relating to a mutual fund scheme or unit beyond working hours.
The market regulator has proposed to make it mandatory to report all the tradings of MF units executed by the Designated Persons of AMC/Trustees, their immediate relatives and by any other person for whom such person takes trading decisions to the Compliance Officer of AMC within 7 calendar days from the date of transaction and to specify that all such transactions above value of Rs 10 lakh are to be disclosed by the AMC on an independent platform as decided by regulator within 48 hours of receipt of the same.

India’s industrial output, measured by the Index of Industrial Production (IIP), came in at a twelve month-high of 19.6 per cent for the month of May, compared with 7.1 per cent in April, data from the National Statistical Office showed on Tuesday.

Meanwhile, consumer Price Index-based inflation (CPI) for the month of June came in at 7.01 per cent, making it two straight quarters of headline retail inflation being above the Monetary Policy Committee’s medium-term target of 4 (+/-2) per cent, thus signaling further rate hikes by the Reserve Bank of India.

CPI for June was primarily driven by sticky food prices. Consumer Food Price inflation was 7.75 per cent in June compared with 7.97 per cent in May. CPI for May was 7.04 per cent. In April, headline retail inflation had touched an eight-year high of 7.79 per cent.

The sub-groups that saw the sharpest year-on-year hike in June included vegetables, spices, fuel and light, and footwear.

On June 8, the six-member MPC of the RBI unanimously decided to raise the repo rate by 50 basis points. This followed an off-cycle rate hike of 40 basis points, making it 90 bps rate hike in just a span of a little over a month, and analysts expect two more rounds of big rate hikes.

On the industrial output front, the biggest driver was electricity, which rose 23.5 per cent. Manufacturing output grew by 20.6 per cent, while mining output grew by 10.9 per cent.

Five things to do if you lose your passport while traveling abroad :-ET July 12-2022

The biggest nightmare when you're travelling abroad is to lose your phone, wallet or passport.

A passport is the most important document you carry while travelling abroad. It is a government authorized document that ensures foreign authorities that you are an Indian Citizen.

Think you check all the immigration boxes? Find out

The loss of passport should be immediately reported to the nearest Police Station and to the Passport Office, or  the Indian Mission. If required, you can apply for “Re–issue” of passport.

Here is a step by step guide to what you need to do...

1. File a police complaint

Once you realize you have lost your passport or it has been stolen, you should go to the nearest police station and file a complaint.
Make sure to collect a copy of the report because it serves as a proof of loss of your passport. Also, a police report helps you with embassy-related formalities like applying for a new passport or an emergency certificate.

2. Contact the nearest Indian Embassy or Consulate

The next essential step is to visit or contact the nearest Indian embassy or consulate. Indian embassies abroad are there to help citizens who are stuck abroad or facing any problem such as a lost passport.

3. Apply for a new passport or an Emergency Certificate

You have two options – you can either apply for a new passport or get an emergency certificate. If you decide to apply for a new passport, you will have to wait for minimum a week to get the new passport.

Duplicate passports are not issued. However, a new passport with different passport number may be issued with fresh validity.
Documents you need to apply for a new passport
  • Proof of Present Address
  • Proof of Date of Birth
  • Affidavit stating how and where the passport got lost/damaged (Annexure 'F')
  • Police report in original
  • Self-attested photocopy of first two and last two pages, including ECR/Non-ECR page of old passport, if available.
  • Original EC/Seizure Memo

Photocopy of your old passport is not a mandatory document to be submitted in case of lost/damaged/stolen passport.
But you will be required to produce, the previous passport details like passport number, Date of issue, Date of expiry and place of issue, while filling the passport application form.

If you can't wait for a week, apply for an Emergency Certificate. This travel document can be used once to authorize travel of an Indian citizen who has lost their passport, to return to India.

The documents you need to apply for an Emergency Certificate are
  • Copy of lost passport (both sides)
  • Copy of police report
  • Passport size photos
  • Application for submitting an EAP-2 form
No matter which option you choose, you'll have to get your visa stamped again.

4. Apply for re-issue of visa

If you lose your passport while travelling abroad, you will also end up losing any visa you might have.

You can get your visa back by visiting the respective country’s embassy that issued your visa in the first place. You will need a copy of your old visa and the police report filed.

You will also need your new replacement passport and/or Emergency Certificate.

5. Reschedule your flight and claim travel insurance

It might be impossible for you to catch your scheduled flight if you don't have enough time to do the above steps and get your travel documents in place.

Check for alternatives and connect with the airline for possible alternatives.

Even though travel insurance isn't mandatory for all visas, it is highly advised to get yourself covered over the course of your trip.

When you lose your passport, contact your travel insurance provider at the earliest and tell them about the case. Keep the Police Report and receipts related to expenses incurred due to passport loss handy.

Cops guarding Abe couldn't recognise suspicious activity: Report :-rediff.com used here for educational purposes only and it is not a commecial blog.

Police officers on duty at the venue where former Japanese prime minister Shinzo Abe was shot didn't recognise a suspicious man in the crowd until hearing the first gunshot, Japan's public broadcaster NHK reported on Saturday.

Abe died after being shot Friday by a gunman during a speech in the western city of Nara while campaigning for Sunday's upper house election.

Police arrested gunman Tetsuya Yamagami, 41, a resident of Nara, at the scene.

Yamagami worked for the Maritime Self-Defence Force (MSDF) for three years until around 2005, NHK quoted defence sources as saying.

He was arrested at the site and local police retrieved what appeared to be a handmade gun from the vicinity of where the former prime minister was shot, according to government reports.

Japan's National Police Agency said that considering the circumstances of the crime scene, it plans to review the day's security arrangements for the former prime minister, NHK reported.

The agency cites possible problems with police arrangements for patrolling the area behind where Abe was speaking, the report said.

The report further states that some security experts point out the seriousness of police officers failing to stop the gunman from firing at Abe.

"They say, first and foremost, the officers should have prevented the assailant from getting anywhere near Abe."

On Saturday, the head of police in Nara Prefecture, Kazuo Ohashi, said the potential security issues in the case of the assassination of Shinzo Abe cannot be denied.

'There is no denying that there was a security issue there,' the official said in a press conference.

According to Ohashi, the assassination was an act of 'inexcusable barbarism', and it is necessary to investigate the case 'in the most thorough way'.

Japanese prime minister Fumio Kishida earlier in his live address to the country on Friday said 'this is not a forgivable act', and that authorities would 'take appropriate measures to handle the situation'.

Kishida further said that the motive behind Abe's shooting is not known.

The Japanese PM also requested everyone to not speculate about any political ramifications at the time.

Adani Group dials 5G, Reliance Jio and Bharti Airtel could face big fight for revenues :-ET July 11,2022

Synopsis

Industry executives expect the cash-rich Gautam Adani-led conglomerate to engage in a possible bidding battle with Reliance Jio and Bharti Airtel for 5G airwaves in both the coveted but expensive 3.3-3.67 GHz and the cheaper 26 GHz bands.

The Adani Group’s entry into the 5G spectrum race and its plans to offer private captive network solutions could result in intensified competition for India’s top telcos who may see their potential revenue from enterprise services as well as from airwaves leasing take a hit, say industry executives and analysts.

Industry executives expect the cash-rich Gautam Adani-led conglomerate to engage in a possible bidding battle with Reliance Jio and
Bharti Airtel
NSE 1.22 % for 5G airwaves in both the coveted but expensive 3.3-3.67 GHz and the cheaper 26 GHz bands. This scenario could queer the pitch for cash-strapped
Vodafone Idea
NSE -0.59 % (Vi) as the latter may be forced to either overbid or totally miss out on any meaningful participation in the auction, starting July 26, further weakening its position in the market.

“Adani’s entry into the 5G spectrum auction and its stated ambitions of offering private captive networks as a service would definitely threaten telcos’ future enterprise revenues streams, probably the mainstay of the 5G business,” Mahesh Uppal, director, Com First India, a telecoms consultancy firm specialising in spectrum regulatory matters, told ET.

Future enterprise business revenues are pegged at almost 40% of overall 5G revenues, according to industry estimates. But Adani’s surprise entry now threatens to rock the enterprises revenue apple cart for the telcos. Uppal added that India’s existing operators will face stiff competition from a powerful adversary like the Adani Group. The moneyed conglomerate will buy spectrum from the auctions and would have the ability to sell enterprise offerings, including private networks, as a service. In addition, like telcos, the new entrant can also lease out 5G airwaves to large corporates keen to invest in captive networks.
“To avoid or limit serious 5G enterprise business revenue losses, incumbent operators would have to be very competitive on the quality, innovation and pricing fronts with their factory automation and other 5G enterprise services offerings,” said Mayuresh Joshi, head of equity research at Indian unit of US brokerage William O’ Neil & Co.

Enterprise services by a telco include services like automating factories, setting up remote education centres or remote operation theatres, and storage solutions using its 5G airwaves. Spectrum leasing, on the other hand, refers to enterprises leasing spectrum from telcos for a fee and setting up captive networks on their own or in a tie-up with, say, a technology company.

The Adani Group,
Reliance
NSE 0.14 % Jio, Bharti Airtel and Vodafone Idea didn’t respond to ET’s emailed queries. On Saturday, the Adani Group said it does not intend to enter the consumer mobility space but would participate in the upcoming 5G spectrum sale to provide private network solutions along with enhanced cyber security at airports, ports & logistics, power generation, distribution, and manufacturing operations. It added that plan on bidding for spectrum aligns with its recent announcement of increasing the Adani Foundation's investments in education, healthcare and skills development in rural areas.

“Even if Adani’s immediate 5G play is around private captive networks, it would definitely target 5G airwaves in both 26 GHz and the more expensive C-band (3.3-3.67 GHz) — also called mid-band — especially since the ecosystem for captives is now developed globally around the latter band and not so much around millimeter waves (26 GHz),” said a senior executive at one of three top carriers.

Sri Lankan protestors claim they found 17.85 million rupees inside President Rajapaksa's official residence Hundreds of anti-government protesters on Saturday stormed into Rajapaksa's residence in central Colombo's high-security Fort area after breaking the barricades, as they demanded his resignation over the island nation's worst economic crisis in recent memory. Money Control :-PTI JULY 10, 2022 / 06:22 PM IST

Hundreds of thousands of people had massed in the capital, Colombo, on Saturday to demand the government take responsibility for mismanaging the nation's finances, and for crippling food and fuel shortages.

The anti-government protesters in Sri Lanka who stormed embattled President Gotabaya Rajapaksa's official residence have claimed to have recovered 17.85 million Sri Lankan Rupees inside his mansion. A video was being shared on social media showing the protesters counting the currency notes that were unearthed.

Protesters said they had found 17,850,000 Sri Lankan Rupees at the President's official residence on Sunday when they stormed into the mansion after breaking the barricades. They have handed over the cash to the local police.

Hundreds of anti-government protesters on Saturday stormed into Rajapaksa's residence in central Colombo's high-security Fort area after breaking the barricades, as they demanded his resignation over the island nation's worst economic crisis in recent memory. Another group of protesters entered the private residence of Prime Minister Ranil Wickremesinghe and set it on fire. The President's whereabouts is still not known. His only communication outside since the protesters stormed into the city has been with the Parliament Speaker Mahinda Yapa Abeywardena, who announced late Saturday night that the President would resign on Wednesday.

President Rajapaksa informed the Speaker about this decision to quit after Abeywardena wrote to him seeking his resignation following the all-party meeting of leaders held Saturday evening. The Speaker would become the acting President in the absence of both the President and the Prime Minister. Later, an election among MPs must happen to elect a new President. Prime Minister Wickremesinghe has also offered to resign.

In May, President Gotabaya Rajapaksa's elder brother and Prime Minister Mahinda Rajapaksa had to quit in the face of massive anti-government protests. The Rajapaksa brothers, Mahinda and Gotabaya, were hailed by many in Sri Lanka as heroes for winning the civil war against the LTTE but they are now blamed for the country's worst economic crisis.

The expected exit of President Gotabaya Rajapaksa on Wednesday and the resignation of Mahinda Rajapaksa as Prime Minister in May is a dramatic fall from grace for a powerful family that has dominated Sri Lankan politics for more than a decade. Sri Lanka, a country of 22 million people, is under the grip of an unprecedented economic turmoil, the worst in seven decades, crippled by an acute shortage of foreign exchange that has left it struggling to pay for essential imports of fuel, and other essentials.

The country, with an acute foreign currency crisis that resulted in foreign debt default, had announced in April that it is suspending nearly USD 7 billion foreign debt repayment due for this year out of about USD 25 billion due through 2026. Sri Lanka's total foreign debt stands at USD 51 billion.

Chartered accountants under the lens as India ups Chinese scrutiny ET

Synopsis

The Ministry of Corporate Affairs has started the process of inspecting books of accounts of more than 500 Chinese companies, a person with knowledge of the matter told Bloomberg recently. Apart from ZTE and Vivo, this includes Xiaomi, Oppo, Huawei Technologies, several Indian units of Alibaba Group such as Alibaba.com India E-commerce Pvt. Ltd., and Alibaba Cloud (India) LLP.

India has tightened scrutiny of China-based firms since 2020, and one of the areas that has brought into focus is the role of CAs or chartered accountants in setting-up shell companies to launder money to China.

Ltd., and Alibaba Cloud (India) LLP, the person said, asking not to be identified as the details are private.

This week, ET reported Indian agencies are probing the local support that two Chinese nationals got in incorporating a company which projected itself as a subsidiary of smartphone maker Vivo.

Two chartered accountants and a company secretary are already under the scanner of the investigators, people in the know said.

The company, Grand Prospect International Communication Pvt Ltd, is a distributor of Chinese manufacturer Vivo's products in Jammu & Kashmir. Forged documents have allegedly been used for the registration of the company and the procurement of director identification numbers.

On Tuesday, the Enforcement Directorate raided nearly four dozen locations linked to Vivo and its related entities including Grand Prospect. The central agency is probing if any shell companies were used to launder money.

CAs facilitated

The two Chinese nationals are shareholders of Grand Prospect. The company falsely projected itself to be a subsidiary of Vivo and was incorporated to conduct fraudulent businesses, according to the deputy registrar's complaint filed with the police.

A probe by the deputy registrar of companies for Delhi and Haryana found that the two Chinese nationals used the professional address of a chartered accountant in New Delhi. The probe also allegedly revealed that the CAs facilitated incorporation of the company by "witnessing" the signatures and documents of the Chinese nationals.

The company secretary, the investigation by the deputy registrar or companies revealed, allegedly certified processes relating to proactive enforcement and compliance of the legal requirements under the Companies Act without verifying them.

No comments from ICAI, so far

On June 20, The Hindu reported that the Government of India has recommended disciplinary action against 400 Chartered Accountants and Company Secretaries (CSs) for their alleged role in incorporating Chinese shell companies in Indian cities by fluting norms and rules. The Institute of Chartered Accountants of India (ICAI), the professional body of CAs in India, said that complaints are being processed in terms of the Chartered Accountants Procedure of Investigations of Professional and Other Misconduct and Conduct of Cases Rules, 2007, and only after the investigation it can be confirmed about allegation and number of professionals involved with this.

India's forex reserves to face $256 billion overseas debt challenge within this year.

India's enormous foreign exchange reserves faces its biggest test in the next 12 months as a record $256 billion of total overseas debt comes up for repayment amid a possible flight of capital due to monetary tightening by the Federal Reserve.

External debt worth $256 billion matures over the next 12 months, according to the September data released by the finance ministry. This is about 43 per cent of the September external debt outstanding at $596 billion.

While the reserves still top $600 billion there could be short term pressures on the currency as the RBI is likely to temper its interventions rather than defend the currency.

The recent US consumer price inflation at 7 per cent at 39 year high, the Fed might be swifter in hiking rates than earlier anticipated that could result in higher pull out of dollars from emerging markets including India. "The expectation of a rate increase by the Fed and other advanced economies is likely to accentuate capital outflow, and this is likely to put pressure on the exchange rate, current account deficit and prices" said M Govinda Rao, chief economic advisor at Brickwork Ratings.

India is still in a comfortable position with reserves adequate to fund over 12 months' imports and this short term debt is just about 40 percent of forex reserves then. " Residual debt maturity is quite manageable in the current environment both in terms of composition and given our reserve position." said Rahul Bajoria, chief India economist at Barclays Capital.

Though reserves position is comfortable compared to 2013, they may not grow as much, or as consistently, as they have in the the last couple of years. "Of course, the impact may be less than that of the 2013 taper tantrum, but the pressure will be real," Rao said. India added only $48 billion to its stock of reserves in 2021 compared to $124 billion in 2020.

Economists are also bracing for an overall balance of payments deficit after almost twelve quarters in March'22 if capital outflows surge as the current account is expected to widen further on rising crude and commodity prices. Moreover India faces a double blow with rising funding costs as interest rates are set to rise as also higher amounts of dollar funds as the capex cycle is set to pick up.

There would certainly be an impact on the way it would intervene in the forex market. "We believe the RBI may no longer continue have to absorb excess foreign currency inflows through intervention, but may at times need to sell reserves to stabilise the currency" , said Bajoria.

Corporates would be caught on the wrong foot in a situation of a volatile rupee with a downward bias, especially those who have not hedged their foreign currency exposure. " From the RBI's perspective, it could be actively monitoring hedging ratios of the corporate sector so that they are well covered" Bajoria said.

Last two years have been benign for the rupee. "But this year with greater volatility of the rupee you would want to make sure that corporates are not making losses just in case the rupee depreciates" said Rao

MY PROBLEM WITH WHAT'S HAPPENING IN THE COUNTY ?????

My problem with what's happening in the country:- is not about BJP and Congress, Or JNU and

anti-nationalism,

Hindu Extremism and
Muslim Extremism, Or
Beef Ban

Porn Ban,
Or

and
that 'India wants to know guy’...
My problem is our mind space being occupied with futile, useless, fruitless, negative,
regressive thinking.....

In an age when this country should be thinking of INVENTIONS and IDEAS, we are discussing subjects mentioned above.... Why isn't the government and media talking about it? Why is the subject of debate not DEVELOPMENT? Why isn't RSS talking about it? Why isn't every Hindu talking about it. Why aren't the Muslims talking about it? Why the news channels aren't focusing on it? Why are Indians on face book not discussing it? Or spreading that idea to the world? Saffron or Green, Beef or Chicken, Porn or Sanskari channels, Temples or Mosques, Jats or Kashmiris aren't tools of development... These subjects of conversations are ANTI DEVELOPMENT And anything that's anti-development is anti-national at least for me..... I want to see my India look better than Switzerland.....
