SC junks PIL seeking cancellation of Centre's relief to stressed telcos from paying statutory dues :-The Economic Times

 

NEW DELHI: The Supreme Court has dismissed a PIL seeking cancellation of Centre's decision of September 15, 2021 to grant relief to the stressed telecom sector from paying statutory dues, saying these are all matters of policy and decision-making is on the basis of experts' opinion.

In a breather to telecom service providers struggling to pay Rs 93,520 crore of Adjusted Gross Revenue (AGR) related dues, the top court on September 1, 2020 gave them a 10-year period to clear their outstanding amount to the government.


A bench of Justices B V Nagarathna and Ujjal Bhuyan said that no doubt, the apex court by its judgment had issued certain directions with regard to the telecom sector but in the backdrop of the COVID-19 challenges, with huge surge in data consumption, online education, work from home, etc., reform measures were found necessary to boost the proliferation and penetration of broadband and telecom connectivity.

"In our view, these are all matters of policy and decision-making which is on the basis of experts' opinion and on emerging situations and exigencies, to be made in the interest of the welfare of the people of India having serious technical and financial implications and, therefore, have to be in public interest.

"Hence, we do not think such Cabinet decisions could be lightly interfered with by a Court of law in the absence of there being any particulars or materials brought to the notice of the Court assailing the Cabinet decisions, as being unconstitutional or arbitrary in nature or contrary to law," the bench said.

Contending that the writ petition filed by petitioner Anshul Gupta was without merit, the top court said any interference at this stage would not only create uncertainty in the implementation of the policy but also jeopardise the policy itself.

"Moreover, the other stakeholders, namely, the telecom service providers are not arraigned as parties to this petition. Therefore, at this stage, we do not think it proper to entertain this petition," it said.

The apex court said it may appear in a first blush that the Cabinet decision to initiate structural and procedural reforms and provide relief measures for the telecom service providers are contrary to its earlier directions.

"It would have been more appropriate for the central government to have filed an application in this regard."But what is to be borne in mind is emerging situations in light of the COVID-19 pandemic that engulfed the world, including India, in the years 2020-2021 and the lifestyle of the people drastically changing on account of the precautions and preventive measures that had to be taken in order to save themselves from being afflicted by the pandemic which resulted not only in deaths but also post COVID-19 disabilities and ill health," the bench said.

"In schools and educational institutions, and offices there was virtual study and work from home respectively. Offices were shut and classrooms were being conducted virtually. Even the governments were run on virtual mode and we could emphasise that video conferencing facility and virtual mode was adapted quickly not only by various stakeholders such as government offices, schools, other private organisations but most significantly by law courts which did not cease to function during the COVID--19 pandemic.

"Huge investments were made for establishment and expansion of the infrastructure as there was need for online education, work from home, inter-personal connect, virtual meetings and virtual courts. Since there was a heavy surge of online facilities being put to use and data consumption, the Governments, Courts, education system and corporate sector in the country depended heavily on the telecom sector and TSPs, in particular, for their various activities and for keeping their systems intact," the bench said.

Sanjiv Bhasin, Director, IIFL Securities, says “Mr Vaidyanathan, according to me, is the best banker in India. I see no letup in this stock. Yes, it is an expensive stock. It has run up far in excess but who is to blame? There was so much under-ownership and IDFC First is headed higher.

Bhasin also says that “Page Industries is a must-have. It is one of the best consumer stocks. Wait for declines to add some. Also, Indian Hotel or a Devyani or a United Spirits cannot be rebuilt.”

IDFC First Bank has managed to outperform its other banking peers but do you think most of the rally is over and it is time to switch into other names?
For the last two years, I was advocating this stock at Rs 30-35. And there would always be the argument on why should it perform? It was a lending institution and so on. And I only pursued that stock on the basis of Mr Vaidyanathan. Today, there is a sell report or whatever, but Morgan Stanley has been bearish from Rs 30. How will he justify Rs 100? The business is humongous.

Mr Vaidyanathan, according to me, is the best banker in India. I see no letup in this stock. Yes, it is an expensive stock. It has run up far in excess but who is to blame? There was much under-ownership and IDFC First is headed higher. As a disclosure for me, IDFC First Bank will be the next HDFC in the making in the next five years. Please stay put. If you are invested and if you are looking for corrections, then this would be a good opportunity as it consolidates closer to Rs 85-90.

Apart from IDFC Bank, which is one large bank, where do you think there could be a trigger? I mean, it is not a bet on the pure big picture of credit growth and a new credit cycle. Where do you think there are these small, small triggers which can generate more upside potential?
First to clarify, you rightly put it that return on equity will take time. This is what Vaidyanathan-ji specified. It was a lending institution which had benchmark nodes at a much higher rate of 9.5%.But almost 80% of that book, he has redone at much lower rates. So yes, there will be this cost of funding. But on the other hand, I think that the growth outlook and the NIMs which they have and the type of variable growth they are looking at is very, very impressive. The other large bank will be ICICI. No question about that. At this price, if there is one stock I can put my money on, it is ICICI Bank. And I think that is now going into four figures, maybe in the next two days and beyond. So 1100, 1150, if we have to go to 20,000, which I am very sure is coming by next week.

You look at the Alcobev industry also very closely. What is your top recommendation?
McDowell has been a personal favourite since long. As a disclosure, I have held it for almost 18 years. The beverage or the alcohol market is just revving up. Look at a stock like Radico Khaitan and look at the whole basket. Who is to talk about the consumption,? You have the G20, you have the World cup cricket. I specified Devyani International as one of my top picks. And I still think that United Spirits in that basket is doing well. I do not track United Breweries because we have United Spirits. But I am very bullish on Devyani International and the whole gamut of consumption.

Entertainment and hospitality in the hotel sector go hand in hand. Brands are going to rule the roost and you have to stay with the largecaps. A disclosure, Devyani and United Spirits are in our portfolio and we continue to be very bullish on both these stocks.

What is your take on Page Industries?
This stock goes back to 2007, 2008, when I was in Deutsche Bank. And we did a pre-IPO placement at 750. And in two years, it was 1,900. And as a hedge fund, we were laughing our way up to booking profit. And look where we are. Someone who makes undergarments is now rocking. And it tells you that the new millennials will pay anything which suits them. Those low jeans and your backside showing the underwear is a sign of strength on a lighter note.

I think Page Industries is a must-have. It is one of the best consumer stocks. The margins and the new portfolio which they have will only add to that. The stock has seen a sharp run-up from that Rs 37,000, 38,000. So wait for declines to add some. But these are themes for the next two, three years which are not going to be changed purely on the basis of brands, which is why I stress that Indian Hotel or a Devyani or a United Spirits cannot be rebuilt.

In a multi-continental effort that could provide a credible alternative to China-led Belt and Road Initiative (BRI), which has pushed many countries into a debt trap besides losing control over their assets, leaders of India-US-Saudi Arabia-UAE-Europe-Japan on Saturday announced a mega joint infrastructure deal to connect Asia with Europe via ports and railroad.

Prime Minister Narendra Modi launching the project said an India-West Asia-Europe connectivity corridor for economic integration would be launched soon. Modi made the announcement flanked by US President US Biden, Saudi Arabia Prime Minister Mohammed bin Salman, President of UAE, EU and key European leaders on the sidelines of the G20 Summit.


"This corridor will show a sustainable way to the whole world," the Prime Minister said.

While the US President described it as a game-changer, Ursula von der Leyen, President, European Union said, "It will be the most direct connection between India, Middle East. and Europe. This will make travel 40% faster."

The deal will seek to connect the two key Gulf states via a network of railway lines, and further to India via shipping lanes in what would rival BRI in the region. While China was not named by any of the leaders the reference was clear as key West Asian powers seek to hedge against Beijing. It is no secret that BRI and CPEC (that passes through PoK) have pushed countries into debt trap and have caused strategic challenges. India has opposed BRI ever since it was launched with Europe joining in since Covid disrupted trust and supply chains originating from China.

Intense negotiations were held among the four countries and other stakeholders since early this week to seal the deal, a person in the know said, adding: "It will be a gamechanger." The negotiations were led by Deputy NSA Vikram Misri.

Amid the chill in Saudi-US ties under the Biden administration and Saudi Crown Prince's goal to put in place a multipolar policy approach, China has made inroads in the Gulf. Last month Saudi Arabia, which has ushered unprecedented reforms, joined BRICS as a new member. Saudi and Russia have also been engaged in trade in recent times via the International North South Transport Corridor in the backdrop of improved relations between Iran and Riyadh.

The plan was initiated during Indian national security adviser Ajit Doval's visit to Saudi in May. This infrastructure deal could reduce shipping times, cost, the use of diesel and make trade faster and cheaper between India and Mediterranean. New Delhi: Indian officials worked round-the-clock behind the scenes in the past few months - and particularly the last week - through several channels, including the ministerial and Sherpa tracks, to reach a consensus on the Leaders' Summit Declaration by narrowing differences on the Ukraine-Russia war.

A consensus that had seemed elusive was achieved following hard bargaining and intense discussions among all G20 negotiating teams amid key meetings, ET has learnt. The need for consensus on the New Delhi Declaration that was adopted on Saturday had also figured in the meeting between US President Joe Biden and Prime Minister Narendra Modi, in the Capital on Friday night.

While India was in constant touch with Russia over the issue, external affairs minister S Jaishankar's meeting with Russian counterpart Sergey Lavrov in Jakarta played an important role, ET has learnt.

Over Friday and early Saturday, the Prime Minister held critical talks on the issue with visiting leaders. Modi's trip to South Africa and Indonesia in recent weeks, and India's forward-looking role in the BRICS process played a significant role, said people with knowledge of the matter. India, Indonesia, Brazil and South Africa took the lead in convincing the remaining G20 members on the need for a consensus.

The Sherpa track, led by Amitabh Kant, and the G20 secretariat played a key role in the past week. Considerable progress was achieved through Friday and Saturday, with National Security Adviser Ajit Doval also making efforts to narrow down differences among various G20 members. India's refusal to give a platform to the Ukraine president, either physically or virtually, also played a role in shaping Russia's decision. Immense pressure had been put on India to invite the Ukraine president.

At least 296 people have died in the 6.8 magnitude earthquake that hit Morocco according to a preliminary toll. A powerful earthquake struck Morocco late Friday, and shaking was felt from Rabat to Marrakesh. There was no immediate word on any casualties or damage. The U.S. Geological Survey said the quake had a preliminary magnitude of 6.8 and occurred about 18 kilometers (11 miles) below the surface. It said the quake hit at 11:11 p.m. and was centered about 56.3 kilometers (34.9 miles) west of Oukaimeden, a popular ski resort in the Atlas Mountains.

Birmingham declares itself bankrupt :-The Times of India Sep 8 2023

LONDON: The local authorities running Britain's second-largest city, Birmingham, have shifted focus on maintaining vital services as they declared the council effectively bankrupt due to an annual budgetary shortfall of millions of pounds. Birmingham city council, which is the largest local authority in Europe, issued a Section 114 notice on Tuesday to say all new expenditures with the exception of protecting vulnerable people and statutory services will stop immediately. The council said the dire situation arose as it must fund an "equal pay liability" that has accrued to date in the region of 650 million to 760 million, but it does not have the resources to do so. Birmingham Council has paid out almost GB.1 billion in equal pay claims since a case was brought against the authority in 2012.

US Presidential elections: Indian American Nikki Haley has emerged as the top Republican presidential contender against US President Joe Biden in the November 2024 polls, indicated CNN in its poll.

The upcoming Presidential election will be contested by a dozen of Republican leaders including Nikki Haley and Vivek Ramaswamy. 

The race is currently being led by former president Donald Trump who is leading by a huge margin from its fellow Republican candidates. However, the recent polls by CNN showed a different picture.

"Hypothetical matchups... suggest there would be no clear leader should Biden face one of the other major GOP contenders, with one notable exception: Biden runs behind former South Carolina Gov. Nikki Haley," said CNN while releasing its poll results.

CNN poll indicates a split among USA's registered voters. There is a division of support between Trump (47 per cent) and Biden (46 per cent), with the demographic contours that defined the 2020 race still prominent.

Biden is about even with Ron DeSantis (47 per cent each), Mike Pence (46 per cent Pence, 44 per cent Biden), Tim Scott (46 per cent Scott, 44 per cent Biden), Vivek Ramaswamy (46 per cent Biden, 45 per cent Ramaswamy), and Chris Christie (44 per cent Christie, 42 per cent Biden).

"Haley stands as the only GOP candidate to hold a lead over Biden, with 49 per cent to Biden's 43 per cent in a hypothetical match between the two," CNN reported.

Nikki Haley enjoys a broader support compared to other Republicans among white voters with college degrees. She holds 51 per cent of that group, compared to 48 per cent or less for other Republicans tested in the poll, the news channel said.

The Haley campaign welcomed the polls saying, "This poll confirms what many Democrats and Republicans are saying: Democrats are terrified of running against Nikki Haley."

"When you ask President Joe Biden who they're really worried about, you'll hear one name. 'If they nominate Nikki Haley, we're in trouble," said a senior Democratic strategist close to the Biden campaign.
