Kidambi and Alibaba Cloud are part of a nationwide investigation carried out by the ministry of corporate affairs (MCA) against more than 700 firms that allegedly have Chinese nationals onboard.
The Supreme Court has directed the Registrar of Companies (RoC) and the Maharashtra police not to take any coercive action against Anand Kidambi, a chartered accountant who allegedly assisted in the incorporation of Alibaba Cloud (India) LLP, till further orders.
Kidambi and Alibaba Cloud are part of a nationwide investigation carried out by the ministry of corporate affairs (MCA) against more than 700 firms that allegedly have Chinese nationals onboard. Based on MCA findings, the Economic Offences Wing (EOW) of Mumbai Police has registered a case against the partners of Alibaba Cloud and others on the allegations of cheating, criminal breach of trust, and conspiracy, along with certain sections of the Information Technology (IT) Act..
The ministry is now mulling getting the Solicitor General of India to represent the government in the matter as the top court has issued notices to the MCA and Maharashtra police to file their reply, people aware of the development said. A senior government official said, "The outcome will act as a precedent and have a bearing on the other cases in the matter. There is a view to get the SG on board." The next hearing is likely in the second week of July.
