What is the best example of hypocrisy of the Indian judiciary system? Replied by Rahul Sharma thru Quora-

 Mamta was traveling in Mumbai local train at 9.30 PM. She was returning from her office. She was late on that day due to burden of work because one of her colleagues was on a leave. Since it was very late, her brother who was 17 had come to pick her up & was traveling with her in train.

A group of young boys were also travelling in the same coach. They realised that everybody had deboarded the train at previous stations & it was only those boys & the girl with her brother in that coach. Under the influence of alcohol, those boys raped that lady in running train while tying her brother with a chain hanging from the roof of the train. They took turns to rape her one by one, not only in her vagina. Her private parts were brutally damaged & then she was thrown from the running train. She died in hospital without being able to register her statement to police. Her brother kept crying, shouting & pleading as his sister was thrown naked.

Her brother decided to fight the legal battle to get the criminals arrested. He was an eye witness. Boys were caught however since they had solid political connections, police chargesheet was compromised & the criminals were announced “not guilty” after 7 years of legal battle in lower court. Victim's brother kept explaining how he saw his sister being raped & murdered however court wanted proofs which he couldn't gather because he couldn't hire an expensive lawyer which criminals could hire.

Victim's brother lost his entire earning & peace during those years, criminals kept committing new crimes being on bail.

Victim's brother escalated the case to High Court but lost the fight after another 5 years of battle. He lost everything but still wanted his deceased sister to get justice.

He escalated the case to Supreme Court. It took another 4 years for him to get the first date in Supreme Court. Victim's brother did not turn up for the hearing, he had passed away in a road accident, a planned road accident. The file was closed.


There are hundreds & thousands of such cases in India. Their stories are more painful than this one. But our Supreme Court takes pride in going on Summer Holidays for one & a half months, every year.

In 2021, the Registrar notified that the Summer Vacation will be from Monday, May 10, 2021 to Sunday, June 27, 2021 (both days inclusive) and will reopen on Monday, June 28, 2021.

Really? Summer vacations? Are the judges kids who are at the risk of sunstroke while the common people are in queues for years to get the dates in Supreme Court, forget about the justice.

Where is equality my lord? How many government offices provide summer vacations my lord?

Those leaves were a part of British culture in India since British couldn't bear the heat in India, they used to go back to their country in summers. Our SC judges are quietly keeping the tradition for their own benefits.

The judges who cannot judge their need to be in office cannot be expected to judge what is right & what is wrong.

This in my opinion is the best example of hypocrisy of our judicial system. Government doesn't want to touch this issue because they want Supreme Court judges to be their darlings. Out of 365 days in a year, they work for less than 200 days as the files keep piling. Each file waits for its turn which never comes in some cases.
