Private telcos to hike tariffs in H2; FY23 revenues to jump by 25%: Report A growth in average revenue per user is essential for the industry to invest in the network and spectrum, and if they do not do so, it can result in poor service offerings, Crisil said in a report :-Business Standard

The country's top three private  operators will resort to another round of  in the second half of the current fiscal and will close FY23 with a revenue growth of 20-25 per cent, a report said on Tuesday.

A growth in average revenue per user is essential for the industry to invest in the network and spectrum, and if they do not do so, it can result in poor service offerings, domestic rating agency Crisil's research wing said in a report.

After years of intense competition following the entry of the deep-pocketed Reliance Jio, the industry had started hiking tariffs from December 2019.

"...revenue of the top three players is expected to grow a robust 20-25 per cent this fiscal," the note said, adding that the operating profit margin will expand by 1.80-2.20 per cent during the fiscal.

It said after a slow 5 per cent growth in the ARPU (Average Revenue Per User) in FY22, the crucial number is set to grow by 15-20 per cent in FY23 as the full impact of the hikes carried out in the previous fiscal plays out, and also on the back of the newer hikes which are expected in the second half of the current fiscal.

Since players are expected to spend incrementally on network and regulatory capex in FY23, ARPU growth and tariff hikes could ease some pressure on their books, it said.

In the fiscal gone by, there was a fall in the overall number of subscribers as 3.70 crore inactive users were weeded out, the report said, adding that the active subscribers rose during the year.

The three top  witnessed a 3 per cent rise in the number of active users by adding 2.90 crore subscribers to the tally, it said.

saw its total subscriber base fall sharply between August 2021 and February 2022. However, the share of its active subscribers reached 94 per cent in March 2022, compared with 78 per cent in the first quarter of last fiscal, it said, adding that  added 1.10 crore active subscribers during the fiscal year to take its share of active users to 99 per cent.

For Vodafone Idea, it was a "mixed bag" during FY23 as the company lost 3 crore active subscribers because of low capex in 4G and "deterioration of services", the rating agency said.

Revenue of Big 3 telcos may grow robustly by 20-25% in fiscal 2023: CRISIL :-ET

NEW DELHI: The revenue of the Big 3 telcos—Reliance Jio, Bharti Airtel and and Vodafone Idea—may rise by 20-25% in fiscal 2023, on the back of the tariff hikes taken late last year, ratings agency Crisil said in a report.

“In fiscal 2023, ARPU (average revenue per user) should grow 15-20% due to the full-year impact of tariff hikes in fiscal 2022 and fiscal 2023 (anticipated in the second half). However, this will be partially offset by the ‘downtrading’ of recharges,” the ratings agency said in a research note released Tuesday.

Telecom operators are also expected to spend incrementally on networks and regulatory capex in fiscal 2023, which may impact the ARPU growth, and tariff hikes “could ease some pressure”.

“As a result, revenue of the top three players is expected to grow a robust 20-25% this fiscal. Earnings before interest, tax, depreciation, and amortisation) is seen expanding 180-220 bps for the year,” Crisil said.

Vodafone Idea in talks with Amazon, PEs for Rs 20,000 cr investment Vodafone Idea needs the money for capex and to bid for 5G auctions :-Business Syandard May 30,2022

American retail major,  and a clutch of investors are in talks with the Aditya Birla group to invest up to Rs 20,000 crore in the latter’s struggling wireless telephony company, . The proceeds of the sale will be used to bid for the upcoming 5G auction of spectrum and in capital expenditure for the rollout of services by year-end, say banking sources.

Apart from Amazon, the Birla group is also talking to several private equity investors who are planning to take an exposure in the Indian telecom sector. “The talks are on with several players and an announcement on the new investors is expected soon,” said a banking source. “The talks are on to get equity investments of upto Rs 10,000 crore and rest is likely to be in debt,” the source said.

The spokespersons of the Aditya Birla group and  declined to comment.

The shares of  closed up 4.14 per cent to Rs 9.3 a share – giving the company a valuation of Rs 29,870 crore as on Monday.

The new investors have raised queries on the role of the Indian government in the management once the government picks up stake in the company in lieu of its dues. The company has decided that the effective date for calculation of the Net Present Value of the interest being converted to equity by the Indian government will be January 10, this year. The NPV of the interest liability on moratorium period amounting to Rs. 16,130 crore towards AGR (adjusted gross revenues) dues and deferred spectrum liabilities

“The investor will come in once this process (government acquiring stake) is completed,” the source said.

The investors are interested in investing in  after the government took several steps to help the telecom sector. In March this year, the DoT issued a direction to return the financial bank guarantees related to past spectrum auctions to the company. Till date, bank guarantees worth Rs 16,000 crore have been returned - thus helping the company financially.

Besides, both promoters allo invested via fresh preferential equity infusion of Rs 4,500 crore. The shares were issued to the promoters at a price of Rs 13.3 per equity share. Of this, Vodafone Group contributed Rs 3,375 crore and the Aditya Birla Group contributed Rs. 1,125 crore. The combined shareholding of promoters after the preferential issue is 74.99 per cent. Post conversion of interest into equity, the government shareholding is expected to be 33 per cent.

The company is keen to invest in the 5G technology based services after successful testing in Pune and Gandhinagar. Following the consultation on 5G pricing, the Telecom Regulatory Authority of India (TRAI) has incorporated several requests from the industry and the 5G spectrum pricing has come down by 36 per cent from its initial estimates.

The TRAI also recommended the spectrum payments to be spread over the life of spectrum as compared to 50 percent upfront payment as in the previous auction, another step to help operators manage their cash flows more efficiently.

EY employees seek clarity amid reports of split :-ET May 30 2022

 Synopsis

Following the development, which caught even its senior-most partners by surprise, a few global leaders assured staff that their interests and well-being would be taken care of if indeed the firm went ahead with the separation plan. They said the split move was still in the early stages of deliberation.

EY's India employees were seeking greater clarity and attempting to assess the personal and business implications after reports emerged last week that the Big Four accounting firm was thinking of splitting its audit and advisory businesses, amid rising regulatory concerns over conflict of interest following a string of incidents involving auditors globally as well as in India.

Following the development, which caught even its senior-most partners by surprise, a few global leaders assured staff that their interests and well-being would be taken care of if indeed the firm went ahead with the separation plan. They said the split move was still in the early stages of deliberation.

EY global chief executive Carmine Di Sibio on Friday communicated to employees that "with the changing competitive, regulatory and market landscape, work is ongoing to evaluate strategic alternatives." Officially, EY said in a statement: "We are in the early stages of this evaluation, and no decisions have been made."
ET spoke to staff members of EY in India at various levels to understand the move's potential impact on people and business in the country. The questions on the minds of senior partners were about their work positions in the new hierarchy, managing clients during a transition, and about the hefty sum they would get if the advisory businesses opted for an initial public offering (IPO).

Mid-level partners were more concerned about their possibilities for advancement under the new structure, any changes in remuneration that may result from the shift, and the potential makeup of the new management teams.

The anxiety at lower levels of the workforce were mostly regarding changes in their work environments. Responding to a questionnaire by ET on the likely split and its India impact, EY said: "We routinely evaluate strategic options that may further strengthen EY businesses over the long-term. Any significant changes would only happen in consultation .with regulators and after votes by EY partners."

The organisation added that it regularly conducts "scenario planning and review of EY businesses on a global basis to determine that we have the optimal strategy, structure and footprint to focus on delivering high-quality audits and exceptional service to all clients across EY service lines."

EY India under chairman Rajiv Memani has jumped to the top of Big Four leaderboard by investing ahead of time in new service lines,

EY India under chairman Rajiv Memani has jumped to the top of Big Four leaderboard by investing ahead of time in new service lines, employing an aggressive market-focused strategy, and focusing on fast-growing customers rather than just conventional large industrial organisations. As a result, the firm is now the dominant Big Four in India despite being No. 3 globally in terms of top line and people.

The company employs about 80,000 people in India, including 33,000 workers - more than 550 partners - in the India servicing business.

"The firm was well on its way to becoming the first ₹10,000 crore professional services business in India in the next year or so in a short time frame. We just had our best year ever and now suddenly there is uncertainty," an EY partner who has worked with the firm for 30 years told ET.

Canada is planning big changes in its Express Entry immigration route :-ET

 Synopsis

Currently, the Express Entry system ranks candidates from a general pool, using factors such as age, education, work experience, job offer, language skills (including in French). Those who meet the cut-off in the Comprehensive Ranking Score (CRS) are invited to apply for permanent residence in Canada.

CANADA is planning a major overhaul for its point-based Express Entry system - allowing the Canadian government to invite candidates who fulfill real-time labour requirements.

According to the proposed bill, the new version of the Express Entry system will allow invitations to be based on criteria like specific academic credentials, and industry-based occupations.Immigration minister Sean Fraser indicated that the Express Entry program as it stands today is being reviewed along these lines in various discussions with stakeholders, or in public forums.

Currently, the Express Entry system ranks candidates from a general pool, using factors such as age, education, work experience, job offer, language skills (including in French). Those who meet the cut-off in the Comprehensive Ranking Score (CRS) are invited to apply for permanent residence in Canada.

Immigration to Canada via Express Entry is classified into three classes

  • Canadian Experience Class (those having at least a year’s experience in Canada)
  • Federal Skilled Workers (skilled workers having qualification and experience)
  • Federal Skilled Traders (those having work experience)
  • Canada is set to resume its Express Entry draws for all three classes in early July, and expects the wait time for new applications to be 6 months - as was the case pre-pandemic.

Canada had halted Express Entry draws for the CEC category in the latter half of 2021 and draws for FSWP candidates were halted since December 2022.

Recently, the country also announced additional benefits for international students.

  • Starting in summer 2022, international students in Canada and have a post-graduation work permit expiring between January and December 2022 will qualify for an additional open work permit valid up to 18 months. “We are exploring a simplified, expeditious process for this, and details will be made available in the weeks ahead,” states IRCC.

About 95,000 PGWPs will expire in 2022, and as many as 50,000 PGWP holders could benefit from this new open work permit.

Indians have remained the top benefactors of PR permits as well as student visas. In 2020, Indian citizens bagged 50,841 invites to apply for permanent residence in Canada, under the ‘Express Entry’ route. In 2021, nearly 100,000 Indians became permanent residents of Canada as the country admitted a record 405,000 new immigrants in its history.

  • There are over 622,000 foreign students in Canada, which included 217,410 Indians, as of December 31, 2021.

‘Absolutely committed’ to stay invested in Vodafone Idea: KM Birla :-ET

NEW DELHI: Aditya Birla Group (ABG) chairman Kumar Mangalam Birla said he is ‘absolutely committed’ to stay invested in the ailing telecom operator Vodafone  Idea.

“As of now, we are very committed. The intent is to find a financial partner to come and invest in the company,” Birla told BQ Prime in an interview, on the sidelines of the World Economic Forum in Davos, adding that the worst is behind for the telco.

“I think that’s in the works [equity conversion]... most important thing to do now is to get funding for which discussions are happening with investors around the world… not the most easiest to happen because the company was in trouble as we know. Therefore, it takes some time for people to start feeling confident about the business,” Birla said.

He said the telco’s performance seems to be improving quarter-on-quarter and that the government’s relief package has been a huge booster for the entire sector.

“The operational performance is much better. The government package is a huge investment.. So we do think we are on the cusp of some good things happening,” Birla said.

Govt to take action against fake reviews on e-commerce platforms Department of Consumer Affairs to hold meeting with e-commerce entities and stakeholders on Friday to discuss magnitude of fake reviews and prepare a roadmap ahead :-Contents Source Business Standard May 26 2022-Used here for educational purposes only.

The consumer affairs ministry along with Advertising Standards Council of India (ASCI) will hold a virtual meeting on Friday with stakeholders including e-commerce entities to discuss the magnitude of fake reviews on their platforms, which mislead consumers into buying online products and services.

The purpose of the meeting is to prepare a road map ahead. The discussions will be broadly based on the impact of fake and misleading reviews on consumers and possible measures to prevent such anomaly, the ministry said in a statement.

Consumer affairs secretary Rohit Kumar Singh has written to all stakeholders: E-commerce entities like Flipkart, Amazon, Tata Sons, Reliance Retail and others, besides consumer forums, law universities, lawyers, FICCI, CII, consumer rights activists, etc. to participate in the meeting.

The secretary has flagged with stakeholders results of a EU-wide screening on online consumer reviews across 223 major websites.

The screening results underlines that at least 55 per cent of the websites violate the unfair commercial practices directive of the EU, which requires truthful information to be presented to consumers to make an informed choice.

Further, in 144 out of the 223 websites checked, the authorities could not confirm that traders were doing enough to ensure that reviews were authentic, i.e., if they were posted by consumers who had actually used the product or service that was reviewed, the statement said.

The secretary said in the letter that consumers are increasingly shopping online for purchase of goods and services with growing internet and smartphone use.

"Given that e-commerce involves a virtual shopping experience without any opportunity to physically view or examine the product, consumers heavily rely on reviews posted on e-commerce platforms to see the opinion and experience of users who have already purchased the goods or service," he said.

As a result, due to fake and misleading reviews, the right to be informed, which is a consumer right under the Consumer Protection Act, 2019, is violated, he added.

"Since the issue impacts people shopping online on a daily basis and has a significant impact on their rights as a consumer, it is important that it is examined with greater scrutiny and detail," the secretary added.

Important DT Judgment -- Netesoft India Ltd. v. Dy. CIT

    DT Latest Caselaw

Netesoft India Ltd. v. Dy. CIT

Decision : In assessee s favour.

Loss-Set off-Set-off of LTCL on sale of quoted equity shares against LTCG earned on sale of properties--AO denied set off on the ground of transactions of sale of quoted equity shares being exempt from tax under section 10(38)

    Facts:

Assessee earned long-term capital gains (LTCG) of Rs. 127 lakhs on sale of certain properties. Assessee had also reflected LTCG on sale of quoted equity shares for Rs. 48 lakhs which was claimed exempt under section 10(38) since sale transactions were charged to Securities Transaction Tax (STT). At the same time, assessee suffered long-term capital loss (LTCL) of Rs. 311 lakhs on similar sale of quoted equity shares transactions which were also subjected to payment of STT. Assessee, in its computation of income, claimed set-off of this loss against LTCG aggregating to Rs. 175 lakhs earned on properties and equity shares. The balance amount was carried forward to subsequent year. AO denied set-off and carry forward of stated losses on the ground that since long-term capital gains were exempt from tax, losses of similar nature would not be available for such adjustment.

    Held:

Concept of income including losses would apply only when entire source was exempt from tax and not in cases were only one particular stream of income was falling in exempt provisions. The income contemplated under section 10(38) was only a part of source of capital gains on shares and only a limited portion of source was treated as exempt and not entire capital gains. Accordingly, assessee would be entitled or set-off of long-term capital losses of Rs. 311 lakhs against aggregate long-term capital gains of Rs. 175 lakhs and entitled to carry forward unutilized losses.
