AN APPEAL TO OUR RESPECTED MADAM FINANCE MINISTER :-NOT TO EXTEND THE DATE FOR FILING ITRs THIS TIME

In our country it has become a general practice among many Government departments be it Income tax department, Municipal corporations Institutions like ICSI to extend the last date for deposit of dues or filing of Income tax returns.

Let us focus on Income Tax wherein last date for filing Income tax returns is July 31 for certain tax payers like Individuals. In case of returns not getting filed in time there is clear law to file returns but with late filing fee. But from last so many years it has become general practice of our Income tax department to keep on extending last dates which cause further laziness among already lazy citizens.

The last date gets extended just to please the citizens for political gains only and nothing else. This is high time that such practices of extending dates gets stopped and Indian Citizens gets disciplined once for all.

Finance Minister is hereby requested to follow law and not to entertain any such move for extension of last dates which is loss to my country's Exchequer. Portal of Income Tax department is working fine but problem happens due to thousands of tax return filers who just keep sleeping and are not proactive but overload the site at last moment.

This time even Direct Taxes Committee of ICAI is not approaching you Respected Madam for the extension of last dates for filing Income Tax returns so that clients of Professional CAs get disciplined.

Dear Professional Colleague,

As you may be kindly aware that the due date to file ITR Forms for certain assessees as specified in clause (c) of Explanation 2 to section 139(1) of the Income-tax Act, 1961 for Assessment Year 2022-23 is 31st July, 2022 which is just round the corner and fast approaching. We are sure the work regarding the ITR filing of clients is in full swing and our members would be able to achieve the said deadline as always.

In this regard, we wish to inform that the Direct Taxes Committee (DTC) of ICAI is not in favour of making any representation for extension of any due date. It will be appreciated that such a step is counter productive for professional interests for the reasons as below:

  1. With extended due date, efforts and expenses increase, fees do not increase and as a consequence contribution reduces.
  2. Time for continuing education and knowledge updating and even for leisure is reduced causing long term adverse  consequences.
  3. CAs are not required to pay cost of delay and taxpayer who are subjected to costs, their associations may represent.

Therefore, you are hereby requested to please enlighten taxpayers to provide data in time to avoid unpleasant consequences. Further, representation has been made by DTC of ICAI to CBDT with regard to issues on the Income Tax portal. Moreover, for such issues, the CBDT may extend due date suo moto.

Please take care to discharge assignments diligently, take due representation from assessee for income computation and mandate to upload ITR. Please do not carry any pressure, work with pleasure which will lead to prosperity.

Happy Learning!

Warm Regards,

Chairman

Direct Taxes Committee
